These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Peetu Inc., a California corporation ("Company," "we," "us"). These Terms govern your access to and use of the William mobile application, desktop application, web presence, and all associated services (collectively, "William" or "the Service").
By creating an account, downloading the application, or using any part of the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy, which is incorporated herein by reference.
The Company makes no representation that William is appropriate or suitable for any specific mental health condition. You use William entirely at your own risk and discretion. The Company expressly disclaims any liability arising from your reliance on William's insights, suggestions, or AI-generated content for any medical, psychological, or health-related purpose.
You must be at least 13 years of age (16 in certain jurisdictions) to use William. By using William, you represent that you meet this age requirement and are legally capable of entering a binding contract. The Company is not liable for access by users who misrepresent their age or authority.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at support@iamwilliam.xyz of any unauthorized account access. The Company is not liable for any loss or damage arising from your failure to maintain account security or from unauthorized use of your account.
You agree to use William only for lawful purposes. You may not:
We reserve the right to suspend or terminate your access for any violation without prior notice and without liability to you.
You retain ownership of content you create within William (journal entries, voice recordings, conversation history). As described in our Privacy Policy, this content is processed locally on your device and is not accessible to us. You grant us no rights to your emotional or personal content. You are solely responsible for all content you create and any consequences arising from it. The Company has no obligation to review, monitor, or retain any user content.
William, including its design, interface, branding, AI models, code, and all associated materials, is owned by Peetu Inc. and protected by applicable intellectual property laws. The William name and bear character logo are trademarks of Peetu Inc. You may not copy, reproduce, distribute, modify, or create derivative works from any part of William without our prior written consent. Unauthorized use may result in immediate termination and legal action.
William's optional social features connect users based on AI personality matching. The Company does not control, endorse, or guarantee the conduct, accuracy, or safety of other users. You interact with other users entirely at your own risk. The Company is not liable for any harm, loss, or damage arising from interactions with other users. We reserve the right to modify, suspend, or remove social features at any time without notice or liability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WILLIAM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND FREEDOM FROM ERRORS OR INTERRUPTIONS.
THE COMPANY DOES NOT WARRANT THAT: (A) WILLIAM WILL MEET YOUR REQUIREMENTS; (B) WILLIAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY RESULTS OBTAINED FROM USE OF WILLIAM WILL BE ACCURATE OR RELIABLE; OR (D) ANY DEFECTS WILL BE CORRECTED. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF WILLIAM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEETU INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE WILLIAM, REGARDLESS OF THE LEGAL THEORY.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS OR RELATED TO WILLIAM SHALL NOT EXCEED FIFTY DOLLARS ($50 USD). THIS LIMITATION APPLIES EVEN IF A REMEDY FAILS ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Peetu Inc. and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of or inability to use William; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; (d) any content you create or actions you take through William; or (e) any dispute between you and another user. We reserve the right to assume exclusive control of any matter subject to indemnification, at your expense.
We may suspend or terminate your access to William at any time, for any reason, with or without notice, at our sole discretion. Upon termination, your right to use William ends immediately. We are not liable for any loss resulting from termination. Sections 9, 10, 11, 13, and 14 survive termination.
Mandatory Arbitration: ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR WILLIAM SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION ADMINISTERED BY JAMS IN LOS ANGELES, CALIFORNIA. THE ARBITRATOR'S AWARD SHALL BE FINAL AND BINDING.
Class Action Waiver: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY.
Small Claims Exception: Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
Governing Law: These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.
Time Limitation on Claims: YOU MUST BRING ANY CLAIM AGAINST PEETU INC. WITHIN ONE (1) YEAR OF WHEN THE CAUSE OF ACTION AROSE, OR SUCH CLAIM IS PERMANENTLY BARRED.
